1. Overview

These Terms govern use of https://www.graceandbloom.co.za and purchases from Grace & Bloom Co. By accessing the site or placing an order you agree to these Terms and our Privacy, Shipping and Returns policies.

2. Eligibility & account

You warrant you are at least 18 and have capacity to contract. You are responsible for safeguarding your account credentials and for all activity under your account.

3. Products, pricing & availability

We may change products, prices and descriptions without notice. All prices are in ZAR (South African Rand) and inclusive/exclusive of VAT as indicated at checkout. We reserve the right to limit quantities and to refuse or cancel orders.

4. Orders & payment

By submitting an order you authorise us and our payment providers to process your selected payment method. Orders are subject to acceptance and availability. We may verify information to prevent fraud.

5. Shipping & risk

Delivery estimates are guidelines only; delays may occur. Risk of loss passes on delivery to the address you provide or to the carrier if you arrange your own collection.

6. Personal care disclaimer

Our products are cosmetics/handmade personal care items, not medical products. Discontinue use if irritation occurs. Always perform a patch test. Keep out of reach of children. Avoid contact with eyes.

7. Indemnity

To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless Grace & Bloom (Pty) Ltd, its directors, employees and agents from any claims, losses, liabilities, damages, costs and expenses (including reasonable attorney fees) arising from your breach of these Terms, misuse of the products, or violation of law or third‑party rights.

8. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business interruption, even if advised of the possibility. Our aggregate liability for any claim shall not exceed the amount paid by you for the product giving rise to the claim.

9. Warranties

We provide the services and products on an “as is” and “as available” basis, without any warranties unless expressly stated or required by the CPA/ECT Act.

10. Intellectual property

All site content, trademarks and packaging designs are owned by or licensed to us. You may not reproduce, distribute, modify or create derivative works without prior written consent.

11. Force majeure

We are not responsible for delays or failure to perform due to causes beyond our reasonable control (including acts of God, labour disputes, lockdowns, carrier failures, or utility interruptions).

12. Governing law & disputes

These Terms are governed by the laws of the Republic of South Africa. Disputes shall be resolved by negotiation in good faith and, failing that, by the courts of competent jurisdiction in South Africa.

13. Changes

We may update these Terms from time to time. Material changes will be posted on the site with a new effective date.
